The 2023 Fall Meet is underway at Keeneland and with it comes those who will put a $2 bet on the longshot. But recent changes to US tax policy mean that those who win certain types of bets must report winning payouts to the IRS. How does this change impact betting? Duke Ferguson, PhD, CPA studied betting on thoroughbred racing and found a 27% increase in types of wagers that do not require payout reporting since the new regulation was introduced. The effect was even stronger among more experienced gamblers. Noncompete agreements predate the American Revolution. One of the oldest cases--Mitchel v. Reynolds from 1711--provides an interesting background to the noncompete agreements I have drafted, negotiated, and litigated. The language on geographic scope remains true today: "where the restraint is general not to exercise a trade throughout the kingdom, and where it is limited to a particular place" a restraint may be enforceable if it is reasonable.It also provides much needed context for the FTC's open hearing next week. to determine whether to ban noncompete agreements for workers at the industrial level. The Mitchel case concerned the owner of a bakery agreeing not to operate a bakery in the same area where he leased his bakery to the plaintiff. The Mitchel agreement was an agreement between principals versus an agreement limiting the ability of a lower wage worker to work elsewhere as a baker. It has been a great experience tracking the changes that Name, Image, and Likeness (NIL) policies are bringing to the U.S. labor system. It's exciting to witness many Gen Z student-athletes being introduced to the concepts of organization and unionization for the first time. I believe that the experience gained by NIL student-athletes will foster a more positive view of unionization among this generation. As these student-athletes transition into their post-college lives, I anticipate we will see a rise in unionization rates. The resurgence of unionization in the United States could very well be driven by the new NIL policies taking shape today, and it will be interesting to watch it all unfold.
